Terms of Service

These Terms of Service ("Terms") govern your use of the NexGen Secure educational platform ("Service"). By using the Service, you agree to these Terms.

1. Eligibility and Account Types

Accounts may be created by:

• Schools and districts
• Teachers and administrators
• Parents and guardians
• Adult individuals, families, and small teams
• Students (only when authorized by a school, teacher, or parent)

Students under 13 cannot self-register.

Users must maintain accurate information and keep login credentials confidential.

2. Description of Service

The Service provides cybersecurity and digital safety educational content, student learning modules, class management tools, reporting dashboards, and related educational resources.

Features may vary by subscription tier.

3. Subscription and Billing

• Subscriptions may be monthly, yearly, or school-year based.
• Payments are processed through third-party payment processors.
• Subscriptions automatically renew unless canceled before the renewal date.
• All payments are final. NexGen Secure does not offer refunds for digital services except where required by law.
• Failure to pay may result in suspension or termination of access.

4. Acceptable Use

Users may not:

• Attempt to breach or bypass security features
• Access accounts or data belonging to others
• Interfere with or disrupt the Service
• Upload harmful or illegal content
• Misuse cybersecurity knowledge learned through the platform
• Use automated tools to access the Service without authorization
• Reverse engineer or copy learning content

5. Intellectual Property

All course materials, graphics, modules, and platform designs are owned by NexGen Secure LLC.

Users are granted a limited, non-transferable license to access the content for educational purposes during an active subscription.

Unauthorized reproduction, redistribution, or modification is prohibited.

6. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy and COPPA/FERPA Compliance commitments.

Schools remain responsible for obtaining necessary parental consent where required by law. NexGen Secure acts as a school official with a legitimate educational interest when processing student data on behalf of schools.

7. Service Availability and Modifications

We strive for reliable operation but do not guarantee uninterrupted availability.

We may modify, update, or discontinue features as needed. Schools will be notified of material changes with reasonable notice.

8. Termination

NexGen Secure may suspend or terminate accounts for:

• Violations of these Terms
• Non-payment
• Harmful activity
• Security threats

Upon termination:

• Access to the platform ends immediately
• Data may be deleted in accordance with our retention policies
• No refunds are granted for unused subscription time

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind.

We do not guarantee educational outcomes, uninterrupted access, or error-free operation.

10. Limitation of Liability

To the fullest extent permitted by law, NexGen Secure LLC is not liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business
• Unauthorized access resulting from user negligence
• Events beyond our reasonable control

Our total liability shall not exceed the amount paid in the preceding 12 months.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Georgia.

Parties agree to attempt informal resolution before pursuing legal action. Unresolved disputes may be resolved through arbitration where allowed.
